These Buyer Terms (the “Terms”) govern your use of the Hypena marketplace (the “Platform”) when you place orders with the independent print shops listed on it. By creating an account or placing an order, you agree to be bound by these Terms.
1. Role of the Platform
Hypena operates the Platform as a digital venue that connects buyers with independent print-shop vendors (each, a “Vendor”). The commercial contract for every order is formed directly between you and the Vendor. Hypena is not a party to that contract and does not produce, warrant, or fulfil any printed goods.
2. Eligibility & Accounts
- You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Platform.
- You agree to provide accurate, current information when creating an account and to keep your contact details up to date.
- You are responsible for safeguarding your credentials and for all activity that occurs under your account.
- Hypena may suspend or terminate accounts that violate these Terms, applicable law, or the rights of others.
3. Placing Orders
When you place an order, you make a binding offer to the selected Vendor to purchase the requested service. The Vendor may accept or reject the offer at its discretion. Prices, turnaround times and delivery options are set by the Vendor and may be updated until the order is confirmed.
4. Payments, Cards & Security
Card payments on the Platform are processed on our acquiring bank’s secure online payment page (Virtual POS). We accept Visa, Mastercard, and ArCa cards; the available card schemes depend on our acquiring bank. By confirming a payment you authorise the displayed amount to be charged to your card.
Prices are shown, and your card is charged, in the currency displayed at checkout — Armenian Dram (AMD) for orders fulfilled in Armenia, or another supported currency where indicated. Any currency conversion applied by your card issuer is outside our control.
All card details are entered on the bank’s payment page over an encrypted (TLS) connection and are authenticated with 3-D Secure (Visa Secure / Mastercard Identity Check) where your issuer supports it. Card processing is performed by our PCI-DSS-compliant acquiring bank; Hypena does not receive or store full card numbers, expiry dates, or CVV/CVC codes.
5. Uploaded Files & Content
You retain ownership of any artwork or documents you upload, but you grant Hypena and the relevant Vendor a limited licence to reproduce, modify (for pre-flight purposes) and print your files solely to fulfil the order. You represent that you hold all necessary rights to the content you upload and that it does not infringe on any third party’s intellectual property.
6. Prohibited Conduct
- Submitting illegal, infringing, defamatory or hateful content for printing.
- Scraping, automating, or otherwise extracting data from the Platform without written permission.
- Harassing or threatening Vendors, their staff, or other buyers.
- Posting reviews you know to be false or paid-for.
- Attempting to circumvent fees or to transact with Vendors off-Platform after meeting them on Hypena.
7. Reviews
You may leave a review only for orders you actually placed and received. Reviews must reflect your honest opinion of the Vendor’s service. Hypena may remove reviews that violate these Terms, are off-topic, or contain personal information about third parties.
8. Delivery & Risk of Loss
Delivery is performed either by the Vendor or by a third-party logistics partner integrated with the Platform. Risk of loss for shipped goods passes to you upon delivery to the address you specified.
9. Returns, Refunds, & Cancellations
Hypena’s baseline policy is described in the Returns & Refunds Policy. Individual Vendors may offer more generous terms but may not offer less than the baseline. Custom-printed items (printed to your specification) may be exempt from cancellation rights as permitted by applicable consumer-protection law.
10. Limitation of Liability
To the maximum extent permitted by law, Hypena will not be liable for any indirect, incidental, special or consequential damages arising out of your use of the Platform. Hypena’s aggregate liability for any direct damages will not exceed the fees Hypena retained from the disputed order.
11. Changes to These Terms
Hypena may update these Terms from time to time. Material changes will be announced in-app or by email at least 14 days before they take effect. Your continued use after the effective date constitutes acceptance.
12. Governing Law
These Terms are governed by the laws of the Republic of Armenia, without regard to its conflict-of-laws principles, and the competent courts of Yerevan, Republic of Armenia have jurisdiction over any dispute. If you are a consumer, this choice of law and forum does not deprive you of the protection of any mandatory consumer-protection rules of the country in which you have your habitual residence.
