These Website Terms of Use (the “Website Terms”) govern your access to and use of the hypena.com websites and any subdomains, mobile sites, and embedded interfaces operated by Hypena (collectively, the “Website”). By accessing the Website, you agree to these Website Terms.
Use of the Hypena platform itself (placing orders, listing services, sending messages, etc.) is additionally governed by the Buyer Terms and the Production Partner Agreement.
1. Role of the Website
The Website presents independent print shops (“Production Partners”) and lets customers order from them. Each order is a contract between the customer and the Production Partner that produces it. Hypena LLC operates the Website, receives orders and payments as the Partner's agent, and handles complaints and refunds as set out in the Buyer Terms and the Returns & Refunds Policy. Hypena does not manufacture printed goods.
2. Disclaimers
To the maximum extent permitted by applicable law, the Website is provided on an “as is” and “as available” basis. Hypena makes no representations or warranties about:
- The quality, safety, legality or fitness for purpose of any printed goods offered by a Production Partner, beyond what the Buyer Terms and the Returns & Refunds Policy provide.
- The completeness or accuracy of listings, Partner descriptions, or user-generated reviews.
- The continuous availability of the Website. Technical maintenance, third-party outages, or force-majeure events may cause interruptions; Hypena will not be liable for loss of business or other consequential losses arising from downtime.
- The conduct of any user, Partner, or third party (including their compliance with applicable laws).
3. Acceptable Use
- Do not scrape, crawl, or extract data from the Website by automated means without our prior written permission.
- Do not attempt to disrupt, probe, or circumvent the security or operation of the Website.
